Terms of Service

These terms cover your use of Faxly on the web, and the Faxly app for Android. Faxly is operated by Mehdi El Moussali ("we", "us").
By sending a fax through Faxly you agree to these terms. If you do not agree, do not use the service.
What Faxly does
Faxly converts a document you upload into fax pages and transmits them over the telephone network to a fax number you choose. It can also, on a subscription, rent you a fax number and receive faxes on your behalf.
Who can use Faxly
You must be old enough to form a binding contract where you live. Faxly is not intended for children.
You may send a fax without an account. If you do sign in, you are responsible for keeping that sign-in secure and for everything done through it. Tell us promptly if you believe someone else has gained access.
Delivery is best effort
Fax is a telephone technology and transmission depends on things outside our control: the receiving machine may be switched off, out of paper, busy, or faulty; the line may be poor; the number may have changed.
We do not guarantee that a fax will be delivered. We attempt transmission, we retry where the carrier reports a temporary failure, and we tell you honestly what happened either way. A delivery confirmation records that the receiving machine accepted the transmission — it does not prove that anyone read it.
Do not rely on Faxly as the sole means of meeting a legal or contractual deadline without confirming receipt independently.
What you may not send
You are responsible for everything you transmit. You may not use Faxly to send:
- Unsolicited advertisements. Sending advertising material by fax without the recipient's prior express invitation or permission is unlawful in the United States under the Telephone Consumer Protection Act and the Junk Fax Prevention Act, and is restricted in Canada under the CRTC's Unsolicited Telecommunications Rules and in many other countries. This applies whether or not the recipient is a customer of yours, and it applies to faxes you send through Faxly to any destination.
- Anything unlawful, fraudulent, defamatory, or infringing someone else's rights.
- Material you do not have the right to send.
- Content intended to harass, threaten or deceive the recipient.
- Bulk transmissions to recipients who have not asked to hear from you.
We may suspend or terminate an account immediately, without refund, where we believe it is being used in any of these ways. We do this to protect the carriers who carry our traffic, whose own rules we are bound by.
You agree to indemnify us against claims arising from what you send.
Your documents
We keep documents you send and receive for 90 days, after which the pages are deleted automatically. The record of the fax — the number, page count, status and time — is kept so your history and your delivery receipts remain accurate.
Your documents stay yours. You keep every right you hold in what you upload. You give us permission to store, convert, render and transmit it — what Faxly has to do to send a fax for you — and nothing beyond that. We do not use your documents to train anything, and we do not read them except where we must to investigate abuse or to comply with the law.
You confirm you have the right to send what you send.
You can delete your account and everything in it at any time from your account page. See the Privacy Policy for the detail.
Our service
The Faxly name, software, design and content are ours and remain ours. You may use the service; you may not copy it, resell it, reverse-engineer it, build a competing service out of it, or reach it through anything other than our own apps and site without our permission.
Health information
Faxly is not offered as a HIPAA-compliant service and we do not enter into Business Associate Agreements. We make no HIPAA compliance claim anywhere.
You may send documents containing health information — many people fax their own medical records — but if you are a covered entity or a business associate under HIPAA, Faxly is not a suitable service for you.
Payment
Faxly is sold as a subscription and, where offered, as a single paid transmission. Prices are shown before you pay, in your own currency where we can, and exclude any tax that applies to you.
Subscriptions renew automatically until cancelled. You may cancel at any time and will keep access until the end of the period you have paid for. We do not refund part-used periods.
Deleting your account does not cancel your subscription. Cancel the subscription separately, through the link on your account page or through the app store you bought it from, or you will continue to be charged.
Where a fax fails before it reaches the carrier, the pages are not counted against your allowance.
Fax numbers
A rented fax number is yours while your subscription is active. If your subscription lapses we hold the number for a short grace period and then return it to the carrier. A released number cannot be reclaimed — it may be issued to someone else. Do not print a Faxly number on anything permanent without keeping the subscription active.
Fair use
Every plan includes a monthly page allowance, shown at the time of purchase. Pages cost us money per page, so accounts that exceed their allowance may be refused further transmissions until the next period.
Availability
We do not promise uninterrupted service. We may change, suspend or withdraw Faxly, and we will give reasonable notice where we can.
No warranty
Faxly is provided as is and as available. To the fullest extent the law allows we make no warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that any fax will reach its destination.
Some places do not allow these exclusions. Where that is so they do not apply to you, and nothing here removes a warranty the law gives you and does not let us exclude.
Liability
To the fullest extent the law allows, our total liability to you for any claim arising out of your use of Faxly is limited to the amount you paid us in the twelve months before the claim.
We are not liable for indirect or consequential loss, including loss of business, loss of profit, or loss arising from a fax that was not delivered or was delivered late.
Nothing here limits liability that cannot lawfully be limited.
Ending your use
You may stop using Faxly and delete your account at any time. We may end your access if you break these terms.
The apps
Where you use Faxly through an app installed from an app store, these terms are between you and us alone. The store is not a party to them, has no obligation to furnish support for the app, and is not responsible for it or for any claim you may have about it. Where the app was obtained from the App Store, Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Your use of the app must also comply with that store's own terms.
General
Force majeure. We are not responsible for a failure caused by something outside our reasonable control — a carrier or network outage, a failure of the telephone system, an act of government, or a natural event.
Severability. If any part of these terms is unenforceable, the rest stays in force and that part is narrowed only as far as necessary rather than struck out.
No waiver. If we do not enforce something immediately, we have not given up the right to enforce it later.
Assignment. You may not transfer your rights under these terms. We may transfer ours to a successor of the business, on notice to you.
Entire agreement. These terms and the Privacy Policy are the whole agreement between us about Faxly and replace anything said beforehand.
Notices. We reach you at the email address on your account, or by a notice on the site or in the app. You reach us at the address below.
Changes
We may update these terms. Where a change materially affects you we will say so before it takes effect. Continuing to use Faxly after that is acceptance.
Governing law
These terms are governed by the laws of Quebec and the federal laws of Canada that apply there, and the courts of Quebec have exclusive jurisdiction.
Nothing here removes any right you have under the consumer protection law of the place you live, where that law says it cannot be excluded.
